Prime Minister of Ukraine
Arseniy Yatsenyuk chaired a meeting to tackle upgrading the state system of
protection of intellectual property rights (IPR). On the outcomes of the event,
which gathered members of central executive authorities and other concerned
parties, such as the US Embassy, American Chamber of Commerce in Ukraine, the
EBA, there has been approved a plan to introduce the reform of intellectual
property rights protection in Ukraine.
According to the data of the Ministry of
Economic Development and Trade, the situation in the area of IPR protection in
Ukraine is unsatisfactory. Among principal problems are numerous
copyright infringement in the Internet, as well as non-payment of earned income
to state-owned media, a lack of clear rules to organize collective management
of copyright and related rights.
Therefore, on the outcomes of the meeting it was
decided to commission the Ministry of Economic Development and Trade of Ukraine
within one month to submit to the Government five key bills to lay the basis
for reforming of the state system of IPR protection.
The bills are to consolidate the main principles
of the reform along core directions, such as: protection of copyright in the
Internet, settlement a market to administer the collecting of royalties for
copyright holders, prevention of patent trolling, simplification of IP
procedure in IT-solution area and public access to licences, as well as
strengthening responsibility for IPR violations.
In addition, the Ministry of Economic
Development and Trade of Ukraine jointly with the State Service of Intellectual
Property of Ukraine shall hold an inventory of the use of computer hardware and
software in the public authorities, and offer an action plan for full
legalization of software in state institutions.
It should be noted that reforming the sphere of
protection of intellectual property is among the top priorities of the
Government towards building a positive image of Ukraine. The creation of the
relevant legislative framework in this sector would facilitate increasing the
investment attractiveness of Ukraine and would make impossible the application
of sanctions applied to a state with high level of Internet piracy. In
addition, it would approach the legislation of Ukraine to the standards of the
European Union and facilitate the implementation of commitments in the framework
of the Association Agreement with the EU.
